Terms & Conditions

These terms govern your purchase and use of products and this website from Seismic DSP, a trading name of Awesome Shiny Things, 9 Newton Place, Office 1, Technology House, Glasgow, Scotland, G3 7PR ("we", "us"). By buying a product, creating an account, or using the site, you agree to these terms and to our End User Licence Agreement(the "EULA"), which forms part of these terms.

Eligibility

You must be at least 18 and able to enter a contract to buy from us.

Products and licences

When you buy a product you are buying a licence to use the software, not the software itself. Your rights and restrictions are set out in the EULA. A licence covers up to five machines unless stated otherwise.

Orders and payment

Payment is taken by Stripe. Prices are shown in pounds sterling and include any applicable tax. Your order is complete once payment clears and we issue your licence key. We may refuse or cancel an order (for example, suspected fraud), in which case we refund any payment taken.

Immediate delivery and refunds

Our products are digital and are delivered immediately. By purchasing you ask us to supply the software straight away and acknowledge that, once download or activation has begun, you lose any statutory right to cancel.

All sales are final and we do not offer refunds. If you are unsure whether a product suits you, do not activate it. Contact support first and we will help. Once a licence key has been activated it is treated as used and is non-refundable. Any exception is entirely at our discretion.

Your account

Keep your account credentials secure. You are responsible for activity that happens under your account. Tell us promptly if you think it has been compromised.

Software provided "as is"

Our software and website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the software will be uninterrupted, error-free, or compatible with your setup.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, loss of data, loss of profit, or damage of any kind arising from your use of, or inability to use, our software or website, including any loss arising from a security incident affecting us. Our total liability to you for any claim will not exceed the amount you paid us for the relevant product. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

Tampering

If you modify, tamper with, reverse-engineer, crack, or circumvent our software or its licensing, your licence terminates immediately, all warranties and support end, and we accept no responsibility for any consequences.

Changes

We may change these terms, our products, or our prices. Changes apply from the date they are posted; they do not affect orders already placed.

Governing law

These terms are governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction.
